Conditions of Use

You are connected to sajou.fr, a website run by Sajou Distribution, distributor of the Sajou brand.

The present conditions of use are agreed between Sajou Distribution, registered under N° 503 479 776, whose head office is located at 16bis, rue de la Chancellerie, 78000 Versailles, France, and all persons wishing to order via the site sajou.fr, hereafter referred to as the client.

The validation of an electronic order implies prior consultation and irrevocable acceptance of these conditions of use.

The site sajou.fr, including source code, texts, images, and other content, is the exclusive property of Sajou Distribution, who manages all sales and operations. Simple or hypertext links are strictly forbidden without prior authorisation from Sajou Distribution.

The entire site content is protected by authors’ rights legislation. Any usage requires prior authorisation from Sajou Distribution. Otherwise, violators risk legal proceedings in the administrative tribunals within the jurisdiction of the company’s head office.

Article 1: Acceptance of Conditions of Use

The client accepts these conditions of use from the moment an order is validated by clicking on the acceptance button.

These present conditions of use prevail over all other general or particular conditions. Sajou Distribution reserves the right to modify the conditions of use at any moment. In this case, the applicable conditions will be those in effect at the date of purchase by the client.

Article 2: Confirmation of Order

The order placed by the client on the website will only be considered accepted after confirmation from Sajou Distribution. The client will receive an e-mail acknowledgment confirming the order and the total amount.

Sajou Distribution reserves the right not to confirm an order. Any order refusal will be notified by e-mail.

If an order is placed by postal mail, confirmation will not be sent by letter. Only a refusal of the order will be sent, either by letter or e-mail.

The client cannot cancel the order unless the payment is not accepted or if the amount indicated in the confirmation e-mail is at least 10% higher than the price indicated on sajou.fr.

Article 3: Offer

The products for sale are those listed on sajou.fr.

These products are offered for sale on the site subject to availability.

Article 4: Price, Free Shipping, Invoice

All prices are expressed in Euros.
Sajou Distribution reserves the right to modify prices at any time. That said, the price paid by the client will always be the price displayed at the time of purchase. This price does not include shipping costs, which will be calculated in the order confirmation.
The prices shown include all taxes applicable at the time of order. For shipments outside the European Union, the client is responsible for any taxes and duties related to the importation of goods.
The weight of goods is automatically calculated to include packing costs.

Article 5: Secure Payment

All data related to payment is encrypted to ensure protection during transmission to the payment centre.
The order amount appears on the order confirmation. The client guarantees to Sajou Distribution payment of the order amount by the chosen method.

The client can pay for the order:

  1. By Paypal, a secure internet payment site. Use of Paypal, which requires a valid e-mail address, is free of charge for the client.
  1. By credit card: VISA or Eurocard-Mastercard only. All payments by credit card are processed via the Cyberplus secure payment system, operated by La Banque Populaire and using SSL protocol (secure socket layer). At no time are your bank details accessible to Sajou Distribution, La Banque Populaire, or any intermediary.

Clients are automatically informed of the payment status (acceptance or refusal) with a hypertext link to return to sajou.fr, where the order status is updated.
This system provides greater payment security than by fax transmission of card details, which we also accept.

  1. For customers in France only, by cheque made out to Sajou Distribution for the full amount, including shipping. If Sajou Distribution does not receive the cheque within 10 days or if the cheque is refused by the bank, we reserve the right to cancel the order.

The client can obtain an invoice upon request or by printing it from their account.

Article 6: Non-Payment and Retention of Title Clause

The ordered products remain the property of Sajou Distribution until full and final payment, according to the terms of law n° 80 335 dated 12th May 1980. Sajou Distribution reserves the right to demand the return of all ordered and shipped products in the case of non-payment, with all costs charged to the client.

Article 7: Transfer of Risks

The transfer of risks to the client is effective from the moment the order is handed over to the postal or shipping services. The products are shipped at the client’s risk, regardless of whether the order is carriage free.

Article 8: Order Fulfillment

The order will be filled within the time frame defined on the site at the moment of confirmation from Sajou Distribution.

Article 9: Delivery

The order will be delivered to the address indicated on the delivery note.

The delivery date may vary according to the item ordered, quantities, and destination. The delivery dates indicated on sajou.fr are purely indicative: if the delay is longer than 30 days from the order date, the sales contract can be terminated and the client reimbursed. The delivery is considered completed at the moment the delivery service hands the order to the client. The delivery slip must be signed and dated by the client upon delivery. This slip serves as proof of delivery.

Article 10: Withdrawal, Reservations, Reimbursement, and Replacement

The client has the right to retract any order within ten days from the delivery date to return the product to Sajou Distribution for an exchange or reimbursement, with no penalties, apart from the cost of return shipping.

Upon delivery, the client must verify the conformity and condition of the products.

In cases of delays, damages, partial or total loss of products, or any other issue, the client may refuse the delivery, specifying the reason for refusal on the delivery note or, at the latest, within 3 days after delivery by registered letter to Sajou Distribution.

In case of a delivery error, the client agrees to return the product(s) within 7 days of receipt to Sajou Distribution. Once the products are returned, Sajou Distribution will send out the originally ordered product.

Sajou Distribution cannot accept returns of products due to colour differences, and the colours on the site are not contractual.

If the delivery does not include the entirety of the order, Sajou Distribution agrees to ship the remaining items at their own expense, unless the client prefers reimbursement for the undelivered quantity.

Article 11: Force Majeure

Considered as force majeure, aside from those typically recognized by French court case law: total or partial strikes, transportation blockades, government restrictions, computer breakdowns, telecommunication blockages, notably related to internet usage.

In the event of force majeure, order fulfillment will be temporarily suspended. If the force majeure persists for more than 3 months, the order will be automatically suspended unless otherwise agreed by both parties.

Article 12: Product Retrieval in Case of Absence

If the client is absent during delivery, postal services will leave an advice notice at the delivery address provided. The products must be retrieved at the address indicated on the advice notice. If the goods are not collected, they will be returned to Sajou Distribution, which reserves the right to reimburse the cost minus shipping charges, along with a 20% discount.

Article 13: Guarantee

All products are systematically inspected by Sajou Distribution before shipment. Every effort is made to ensure the products match the description on sajou.fr, with exceptions noted in Article 10.

Article 14: Data Access

Sajou Distribution requests only the necessary information from clients to complete order processing and invoicing.
In accordance with the Information Technology and Freedom Law of 6th January 1978, you have the right to access and modify any personal data.

Requests can be made directly to Sajou Distribution, 16bis rue de la Chancellerie, 78000 Versailles, France, with a photocopy of an identity card.

Sajou Distribution may share your information with other companies who may send offers. If you do not wish to receive these offers, simply send us your name and address.

Article 15: Responsibility and Legal Compliance

Sajou Distribution, as the exclusive operator of sajou.fr, commits to respecting all applicable legislative and regulatory provisions in France. Accordingly, we cannot be held responsible for any legal provisions specific to the country of delivery, as the client is solely responsible for adherence to their country's laws.
Sajou Distribution cannot be held liable for any data loss occurring during the use of sajou.fr.
In any case of liability, Sajou Distribution will be responsible only for the reimbursement of the product and possibly the shipment costs.

Article 16: Cookies

To facilitate navigation on sajou.fr, Sajou Distribution uses cookies. There is no risk associated with this system. A “cookie” does not identify you but records information related to your navigation. In this respect, as stated in Article 14, you have the right to access and rectify this information.

Article 17: Signature

The “continue” button, in conjunction with the authentication and message protection procedures, constitutes an electronic signature.

Article 18: Proof

The electronic records maintained in the sajou.fr system under secure conditions serve as proof of communication, orders, and payments between both parties.

Article 19: Conservation and Filing

The delivery slips and invoices are filed on reliable media and constitute an authentic copy of the original documents, in accordance with article 1348 of the Civil Code.

Article 20: Entirety of the Contract

These terms and conditions represent the entirety of the obligations between both parties. No other terms submitted by the client may supplement or override these terms and conditions.

Article 21: Applicable Law

By placing an order, you fully accept these terms and conditions. These terms, as well as any issues arising from their execution, are governed by French law.

Article 22: Dispute Settlement

Sajou Distribution is available to resolve any disputes. If an amicable resolution cannot be reached, jurisdiction is assigned to the courts within the location of the head office.
