Professional conditions of Use
Article 1: Acceptation of conditions of use
The client accepts the present conditions of use from the moment an order is validated by clicking on the acceptation button.
These present conditions of use prevail over all other general or particular conditions.
Sajou Distribution reserves the right to modify the conditions of use at any moment. In this case, the applicable conditions will be those in effect at the date of purchase by the client.
Article 2: Confirmation of order
The order passed by the client on the website will only be considered as accepted after confirmation from Sajou Distribution. The client will receive an e-mail as acknowledgement of receipt confirming the order and the total amount.
Sajou Distribution reserves the right to not confirm an order. The order refusal will be notified by e-mail.
If an order is passed by postal mail, the order will not be confirmed by letter. Only a refusal of the order will be sent either by letter or e-mail.
The client cannot cancel the order unless the payment is not accepted or if the amount indicated in the confirmation e-mail is at least 10% superior to the price indicated on sajou.fr.
Article 3: Offer
The products for sale are those figuring on sajou.fr.
These products are offered for sale on the site subject to availability.
Article 4: Price, free shipping, invoice
All prices are expressed in Euros.
Sajou Distribution reserves the right to modify the prices at any moment. This being said, the price paid by the client will always be the price displayed at the moment of purchase. It does not include shipping costs, which will be calculated in the order confirmation.
The prices indicated include all taxes applicable at the time of order. For all shipments outside the European Union, the client must pay all relative taxes and duties due to the importation of these goods.
The weight of the goods is automatically calculated to include packing costs.
Article 5: Secure payment
All data relative to the payment of order is encoded so that your information is protected during transmissions to the payment centre.
The amount of the order appears on the confirmation of the order. The client guarantees to Sajou Distribution the payment of the amount of the order by the chosen method of payment.
The client can pay for the order:
- By Paypal, secure internet payment site. Use of Paypal by the client, who must have a valid e-mail address, is free of charge.
- By credit card: VISA or Eurocard-Mastercard only. All payment by credit card goes through the Cyberplus secure payment system, operated through La Banque Populaire and using SSL protocol (secure socket layer). At no moment are any of your bank details accessible to anyone at Sajou Distribution, La Banque Populaire or any technical intermediary.
You will automatically be informed of the status of your payment (acceptation or refusal) with a hypertext link inviting you to return back to sajou.fr and the updating of your order on this site.
For customers in France only, by cheque made out to Sajou Distribution for the total amount, shipment included. If Sajou Distribution does not receive the cheque within 10 days, or if the cheque is refused by the bank, we reserve the right to cancel the order.
The client can obtain an invoice by simple request or by printing it out on their account.
Article 6: Non-payment and retention of title clause
The ordered products remain the property of Sajou Distribution until the definitive and total payment conforming to the terms of law n° 80 335 dated 12th May 1980. Sajou Distribution reserves the right to demand the restitution of all products ordered and shipped in the case of a default on payment, all costs being at the charge of the client.
Article 7: Transfer risks
The transfer of risks to the client is effective from the moment the order is handed over to the postal or shipping services. The products are shipped at the clients’ risk, regardless of whether the order is carriage free.
Article 8: Credit note
Any credit note must be used within the calendar year of issue. Sajou Distribution closes their accounts the 31 December each year, any credit note not used by this date will be considered non-valid.
Article 9: Execution of order
The order will be filled within the delays defined on the site at the moment of confirmation from Sajou Distribution.
Article 10: Delivery
(see retention of title clause)
The order will be delivered to the address indicated on the delivery order.
The delivery date may vary according to the article ordered, the quantities ordered and the final destination. The delivery dates indicated on sajou.fr are purely indicative: if the delay is longer than 30 days from the order date, the sales contract can be terminated and the client reimbursed. The delivery is considered to have been made at the moment the delivery service hands the order over to the client. The delivery slip must imperatively be signed and dated by the client upon delivery of the order. This slip constitutes a proof of delivery.
Article 11: Withdrawal, reserves, reimbursement and replacement
The client has the right to retract from any order within ten days from the delivery date of their order to return the product to Sajou Distribution for an exchange or reimbursement, with no penalties, apart from the cost of the return shipping.
At the moment of delivery, the client must verify the conformity and state of the products.
In the case of delays, deteriorations, partial or total loss of the products or any other problem, the client can refuse the delivery, indicating the reason for the refusal on the delivery note or at the latest 3 days after the delivery by registered letter to Sajou Distribution.
In the case of an error in the delivery, the client accepts to return the product(s) within a delay of 7 days of reception to Sajou Distribution. As soon as the products are returned, Sajou Distribution will send out the product originally ordered.
Sajou Distribution cannot accept returns of products for a difference of colours and the colours on the site cannot be considered as contractual.
If the delivery does not contain the totality of the order, Sajou Distribution accepts to ship the rest of the order, completely at their charge, unless the client prefers to be reimbursed for the undelivered quantity.
In any case, the reservation must be sent within 15 days of reception of the order. Beyond this period, Sajou Distribution cannot accept any claim. If the buyer has not received a reply within 48 hours of the claim, he/she should ensure that the claim has been received by Sajou Distribution.
Article 12: Force majeure
Considered as force majeure, other than those normally taken into consideration by case law in French courts: total or partial strikes, blockades on transport, government restrictions, computer breakdowns, telecommunication blockades, notably concerning the use of internet.
In the case of an incidence of force majeure, the execution of the order will be momentarily suspended. If the incidence persists for longer than 3 months, the order will automatically be suspended, unless otherwise agreed by the two parties.
Article 13: Withdrawal of products in case of absence
If the client is absent at the delivery, the postal services will submit an advice notice at the delivery address indicated by the client. The products must be withdrawn at the address indicated on the advice notice. If the goods are not withdrawn, they will be returned to Sajou Distribution who reserves the right to reimburse the cost, less shipping charges, with a discount of 20%.
Article 14: Guarantee
The delivered products are systematically checked by Sajou Distribution before shipment. Every effort is made to ensure the products are conforming to the description on sajou.fr with the exception of reserves pointed out in Article 10.
Article 15: Data access
Sajou Distribution only requests necessary client information to carry out order procedure and invoicing.
Conforming to the Information technology and freedom law of 6th January 1978, you are able to access and modify any personal data.
This can be affected by a simple request to Sajou Distribution, 16bis rue de la Chancellerie, 78000 Versailles, France, upon presentation of a photocopy of an identity card.
Sajou Distribution may transmit your information to other companies who could send you offers. If you do not wish to receive such offers, all you have to do is send us your name and address.
Article 16:
Sajou Distribution, exclusive operator of sajou.fr commits to respect all legislative and regulatory dispositions applicable in France. To this effect, we cannot be considered responsible for any legal disposition particular to the country of delivery, the client being solely responsible for the respect of their countries laws.
Sajou Distribution cannot be held responsible for any data loss during usage of their site sajou.fr.
Whatever the responsibility clause, Sajou Distribution will only be responsible for the reimbursement of the product and possibly shipment costs.
Article 17: Cookies
To make navigation on sajou.fr easier, Sajou Distribution uses cookies. You are under no risk using this system. A “cookie” cannot identify you. However, it records information relative to your navigation. To this effect, as mentioned in Article 14, you have a right of access and rectification to this information.
Article 18: Signature
The “continue” button associated to the authentification procedure and protection of messages constitutes an electronic signature.
Article 19: Proof
The computerized registers conserved in the system of sajou.fr under secure conditions are considered as proof of communication, order and payment between the two parties.
Article 20: Conservation and filing
The delivery notes and invoices are filed on a reliable support and constitute an authentic copy of the original documents, conforming to article 1348 of the Civil Code.
Article 21: Totality of contract
The present conditions of use express the totality of the obligations of both parties. No other condition of use submitted by the client can integrate or waive the current conditions of use.
Article 21: Applicable law
On passing an order you accept totally our conditions of use. These conditions of use as well as any difficulty occurring during their execution are governed by French law.
Article 23: Dispute settlement
Sajou Distribution is at the clients’ disposal to settle any dispute. Failing amicable settlement of any dispute, the matter shall be transferred to the tribunals situated in the jurisdiction of the head office.
